ORDINANCE NO. 2015 -007 <br />AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA, RELATING TO ROAD <br />IMPACT FEES; AMENDING ARTICLE I, CHAPTER 87 OF THE CODE OF <br />ORDINANCES OF THE CITY OF OCOEE TO PROVIDE FOR A DECREASE IN <br />ROAD IMPACT FEES; PROVIDING FOR SEVERABILITY; PROVIDING FOR <br />CODIFICATION; PROVIDING AN EFFECTIVE DATE. <br />WHEREAS, the City Commission of the City of Ocoee ( "City Commission ") <br />recognizes that the adverse effects of the national recession and the financial and <br />credit crises are still impacting the state and local economy; and <br />WHEREAS, to address, in part, the impacts of these economic issues, the City <br />previously enacted ordinances which temporarily reduced road impact fee amounts; <br />and <br />WHEREAS, the temporary reduction of road impact fees, codified at Section 87- <br />4 of the Code of Ordinances of the City of Ocoee, is set to sunset on April 30, 2015; <br />and <br />WHEREAS, the City has received input suggesting that some of the economic <br />challenges could be addressed in part by permanently reducing the road impact fees <br />assessed to new development; and <br />WHEREAS, in 2014, Lake Transportation Engineering Consultants, Inc., <br />completed a transportation impact fee study (Study) based on existing and potential <br />land use, units of measures, and reflecting full and reduced impact fees; and <br />WHEREAS, the City Commission finds it to be in the best interest of the citizens <br />of Ocoee to try to encourage economic development by reducing the road impact fees <br />assessed to new development and updating the categories as indicated in the Study; <br />and <br />WHEREAS, the City Commission has determined that such a reduction will not <br />adversely impact the ability of the City to meet its financial obligations. <br />
